This decision was made during the court session, in which
representatives from AMD Japan and Intel presented their positions on
the publication of documents collected by the JFTC during the annual investigation
violations of Japanese antitrust laws by Intel.

“Today’s decision shows that truthful information about
Intel’s illegal use of its market monopoly,
will finally see the light of day “, – said Thomas M. McCoy (Thomas M. McCoy),
AMD Executive Vice President Legal and Administrative
director of the company. – “We thank the court for this principled decision,
telling the whole world that Intel has no chance to hide the truth about
their illegal methods of competition neither from justice nor from
buyers who have every right to know the facts. Proof of,
collected by the JFTC will once again convincingly demonstrate the well-known fact
unfair competition from Intel, which intimidates its
customers and forcing them not to do business with AMD.”

JFTC Commission published on March 8, 2021
against Intel, a statement that the company
Intel used its monopoly in the market to dishonest
competition and violated the provisions of Section 3 of the Japan Competition Law.
It was revealed that Intel used illegal methods to combat
popularity of AMD products and with an increase in AMD market share, reaching 22%
in 2021. Illegal methods consisted of setting restrictions on
Japanese computer manufacturers selling desktops and laptops by
all over the world.

The JFTC recommendation was based on the results of an 11 month investigation, in
which revealed signs of unfair competition and
harm to consumers. The Commission found that when Intel
began to lose ground due to the success of AMD, it began to take
targeted steps to limit AMD’s market share. These steps were
in setting restrictions for five Japanese computer manufacturers
(it was later revealed that they were NEC Corporation, Toshiba,
Hitachi, Sony and Fujitsu), which account for 77%
of all processor sales in Japan. Specifically, the JFTC revealed
the following facts:

  • One manufacturer was forced to buy 100% of processors only from Intel,
    the other was subject to restrictions – it has a share of processors from others
    manufacturers should have been less than 10%

  • To reduce sales of AMD processors
    Intel has introduced special discounts for the fact that all computers,
    sold under the same brand, installed Intel processors.

    To achieve these results, Intel took advantage of discounts,
    marketing programs, as well as funds for business development, which were allocated
    parent American organization Intel.

    The JFTC advised that Intel introduced these restrictions in
    response to AMD’s growth in market share from 2000 to 2021. According to
    recommendations, as a result of illegal actions of Intel, the total share of AMD and more
    one small processor manufacturer fell from 24% in 2021 to
    11% in 2021.

    JFTC has set a number of restrictions for Intel. Intel must notify its customers and their employees that it is more than
    cannot provide Japanese computer manufacturers with discounts or other
    types of sponsorship for refusing to buy processors from its competitors.

    Currently, the European Commission and the South Korean Trade Commission are conducting
    investigation of Intel’s activities for violations similar to
    identified by the JFTC.
