Intel responds to AMD lawsuit

Intel responded late last week to AMD’s antitrust lawsuit about two months ago.

Recall that AMD accuses Intel of violating antitrust laws, confirming its lawsuit with numerous examples revealing the details of Intel’s unfair business practices (in total, 38 companies appear in the lawsuit, including large computer manufacturers, wholesale and retail trade enterprises).

After several days of silence, Paul Otellini, Intel’s CEO, responded to the lawsuit with a very general statement, the essence of which was quite predictable: Intel cannot agree with the charges, the company is confident in a favorable court decision and will continue to conduct its affairs as before.

Finally, a more complete response has emerged: a 63-page document is filed with the Delaware District Court denying the accusation of using a monopoly position in the microprocessor market for personal computers. Intel denies that it has impeded the advancement of AMD microprocessors through threats and targeted discounts against computer makers.

Intel believes the capture of significant market share is attributable to continued investment in research and manufacturing. With regard to discounts and marketing agreements, they, according to the document, aim to lower consumer prices.

Intel explains the strengthening of its position not only by its thoughtful actions, but also by AMD’s mistakes. In particular, such a reason is called as insufficient investment in increasing production capacities. In addition, according to the authors of the document, the competitor did not act as aggressively as Intel in promoting laptops, and now is unable to take advantage of the increased demand for this type of product.

As for the cases when Intel in one way or another obstructed the promotion of AMD products, specific counterarguments are given on many points in the document.

For example, according to Intel, in 2021, Sony ditched AMD processors only to reduce the list of purchased components (according to AMD, the real reason was the contract, according to which Sony was forced to use only Intel processors).

AMD claims Intel forced MSI, Atipa and Fujitsu-Siemens to withdraw from AMD Opteron processor release on April 22, 2021. Intel replies to this that Atipa and MSI soon after all expressed support for Opteron, and Fujitsu-Siemens actually manufactures and sells servers based on these high-performance processors.

Couples of this level (“he said that, and I said that”), apparently, are inevitable due to the very nature of the dispute. Keep in mind that accusations and counter-accusations are common in lawsuits. Clarification of the actual state of affairs ? task of investigation and trial that has not yet begun.
